I. General principles

We, Robert Kunzmann GmbH & Co. KG and Kunzmann Fulda GmbH & Co. KG (hereinafter: “Kunzmann”), are pleased by your visit and your interest in our company and our products. The protection of your privacy

The protection of your privacy is of great importance to us. Therefore, it goes without saying that we comply with statutory data protection provisions and treat personal data confidentially. Our data protection practices are based on the EU General Data Protection Regulation (GDPR) and the applicable Federal Data Protection Act (BDSG, as amended).

Below, you will learn which of your data we store when and for what purpose. We also inform you of your rights and provide further legally required information. If you have given further consent—for example when using mercedes-me—personal data may also be transmitted by the dealership to Mercedes-Benz Group AG / Daimler Truck AG / smart Europe GmbH / Kia Europe GmbH / Volkswagen AG. On the scope of data collection, purposes of use and disclosure of data

Personal data arises at various points within the dealership. In addition to supplying personal data when purchasing a vehicle, personal data is processed in particular in connection with service orders. Once the data generated by various sensors in the vehicle (engine temperature, distance sensor, engine speed, etc.) is linked to the vehicle identification number, it constitutes personal data. Further data processing to fulfil legal obligations: Data from the purchase of a vehicle or spare parts and from the provision of service is also used for any required handling of warranty claims or other complaints. In addition, this data may be disclosed to external auditors and/or tax consultants for their advisory and audit purposes. The data is stored in accordance with the legally prescribed retention periods under §§ 146 ff. of the German Fiscal Code or § 257 of the German Commercial Code and deleted after the expiry of these periods.

Centralisation of data within Kunzmann
The dealership transfers master data (name, contact person for companies, address and contact details such as telephone number and email address, as well as vehicle data) to other Kunzmann dealership locations so that the master data can be managed and used uniformly within the corporate group. This also includes forwarding updates to this personal data of which we or another group location become aware. These updates are likewise made available to the other Kunzmann locations. This serves to simplify our processes and spares you from having to provide your master data again when contacting another Kunzmann location.

II. Service offering

When using services, purchasing vehicles / spare parts / accessories and bicycles. Below we explain to you the extent to which we collect and process personal data when using services, when purchasing vehicles / spare parts or ordering new vehicles. 

New Vehicle Order
When ordering a new vehicle, the personal data required for contract execution are collected by the dealership for order processing and customer administration purposes. The personal data necessary for contract execution regarding the ordered vehicle are forwarded to Mercedes-Benz Group AG / Daimler Truck AG / smart Europe GmbH / Kia Europe GmbH as the vehicle manufacturers for further contract fulfilment. Purchase of a used vehicle or of spare parts / accessories and bicycles When purchasing a used vehicle or spare parts, the dealership collects and processes the personal data relevant for contract execution [name, address, details of the purchased vehicle, product, part] for contract fulfilment. 

Credit Check by Creditreform Boniversum GmbH
Our company regularly checks your creditworthiness with Creditreform Boniversum GmbH, Hellersbergstraße 11, 41460 Neuss, when concluding contracts and in certain cases where there is a legitimate interest, including for existing customers. We receive the necessary data from Creditreform Boniversum. On behalf of Creditreform Boniversum, we provide you in advance with the following information in accordance with Art. 14 GDPR: Creditreform Boniversum GmbH is a consumer credit agency operating a database in which creditworthiness information on private individuals is stored. Based on this information, Creditreform Boniversum provides credit reports to its clients, including banks, leasing companies, insurance companies, telecommunications providers, debt collection agencies, mail-order, wholesale and retail companies, and other service providers. Within the statutory provisions, part of the data in the report database is also supplied to other business databases for address marketing purposes. The database of Creditreform Boniversum in particular stores information about the name, address, date of birth, if applicable the e-mail address, payment behaviour and shareholdings of individuals. The purpose of processing the stored data is to provide information on the creditworthiness of the person inquired about. The legal basis for processing is Art. 6(1)(f) GDPR. Reports on these data may only be provided if a client demonstrates a legitimate interest in knowing this information. If data are transferred to countries outside the EU, this is done on the basis of the so-called “standard contractual clauses”, which you can view or obtain via the following link: http://eur-lex.europa.eu/legal-content/DE/TXT/PDF/?uri=CELEX:32001D0497&from=DE.

The data are retained as long as their knowledge is necessary to fulfil the purpose of storage. In general, this is required for an initial storage period of three years. After expiry, it is reviewed whether further storage is necessary; otherwise the data are deleted to the day. In the case of completion of a matter, the data are deleted to the day three years after completion. Entries in the debtor register are deleted to the day after three years from the date of entry order in accordance with § 882e ZPO. Legitimate interests within the meaning of Art. 6(1)(f) GDPR may include: credit decision, business initiation, shareholdings, receivables, credit check, insurance contract, enforcement information. You have a right to information from Creditreform Boniversum GmbH about the data stored about you. If the data stored about you are incorrect, you are entitled to rectification or deletion. If it cannot be determined immediately whether the data are incorrect or correct, you have the right to have the respective data blocked until clarification. If your data are incomplete, you may request completion. If you have given your consent to the processing of the data stored at Creditreform Boniversum, you have the right to withdraw this consent at any time. Withdrawal does not affect the legality of processing carried out based on your consent until withdrawal.
If you have objections, wishes or complaints regarding data protection, you can contact the Data Protection Officer of Creditreform Boniversum at any time. They will assist you promptly and confidentially with all data protection questions. You may also lodge a complaint about the processing of data by Boniversum with the relevant State Data Protection Commissioner for your federal state.

The data Creditreform Boniversum has stored about you come from publicly accessible sources, debt collection agencies and their clients. To describe your creditworthiness, Creditreform Boniversum calculates a score. The score includes data on age and gender, address information and, to some extent, payment experience data. These data enter the score calculation with differing weights. Creditreform Boniversum’s clients use the scores as an aid in making their own credit decisions.

Right to Object: The processing of data stored at Creditreform Boniversum GmbH takes place for compelling legitimate reasons of creditor and credit protection that regularly override your interests, rights and freedoms, or serves the assertion, exercise or defence of legal claims. You may only object to processing for reasons arising from a special situation affecting you, which must be proven. If such special reasons are proven, the data will no longer be processed. If you object to the processing of your data for advertising and marketing purposes, the data will no longer be processed for these purposes. Data Transfer to SCHUFA Holding AG
As part of a contractual relationship, Kunzmann transfers personal data collected regarding the application for, implementation and termination of this business relationship, as well as data on non-contractual or fraudulent behaviour, to SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden. The legal bases for these transfers are Article 6(1)(b) and (f) of the GDPR. Transfers based on Article 6(1)(f) GDPR may only occur if necessary to protect the legitimate interests of the contracting party or third parties and do not override the interests or fundamental rights and freedoms of the data subject requiring data protection.

Data exchange with SCHUFA also serves to fulfil legal obligations to conduct creditworthiness checks of customers (§ 505a and 506 of the German Civil Code). SCHUFA processes the received data and uses it for profiling (scoring) to provide information to its contract partners in the European Economic Area and Switzerland and, where applicable, other third countries (if there is an adequacy decision by the European Commission), among other things, to assess the creditworthiness of natural persons. Detailed information on SCHUFA’s activities can be found in the SCHUFA information leaflet pursuant to Art. 14 GDPR or online at www.schufa.de/datenschutz.

Digital Customer Information after Vehicle Purchase
After vehicle delivery, we will send you a one-off e-mail with a link to an information platform for your vehicle. For this purpose, we process the following data: name, e-mail, vehicle model, customer segment. The legal basis is Art. 6(1)(b) GDPR (contract fulfilment). We use a service provider as a processor for the dispatch. The data will be deleted by the processor no later than 12 months after dispatch.

Order and Shipping Processing in Our Online Shop
As part of contract processing in our online shop, we forward the e-mail address you used for ordering to our shipping service provider to ensure secure delivery and tracking of the shipment. For freight shipments, the telephone number is additionally provided to arrange a delivery appointment with you.

Payment Processing with Adyen
We use the payment service provider Adyen for online payment processing; a Dutch company based in Amsterdam (Adyen N.V., Simon Carmiggeltstraat 6, 1011 DJ Amsterdam, Netherlands).
When paying via Adyen, your payment data are processed directly and exclusively by Adyen. We do not receive complete payment data (e.g. full credit card numbers), but only a truncated reference necessary for order processing. Adyen’s security standards comply with the applicable requirements and thus provide you with secure payment processing. Further information on the handling of personal data by Adyen can be found in their privacy policy at:

Service / Repair and Maintenance

Kunzmann collects and processes the personal data necessary for the provision and billing of services. This also includes internal company documentation of the services provided for evidence purposes. In addition, personal data may be transmitted to other companies involved in the repair (e.g. paint shop). Such companies may receive personal data—such as your name—if required for contract execution.  If you use services (e.g. repair services, maintenance work), the operational data stored in the vehicle together with the vehicle identification number may, if necessary, be read out and processed to provide the contractually owed service. The same applies to warranty cases and quality assurance measures. The operational data document technical conditions of the vehicle or individual components, assist in fault diagnosis, compliance with warranty obligations and quality improvement. This data, in particular information on component stresses, technical events, misuse and other errors, is transmitted together with the vehicle identification number to the manufacturer if required. Furthermore, the manufacturer is subject to product liability. The manufacturer also uses operational data from vehicles for recall campaigns. This data may also be used to verify customer claims for warranty and guarantee. This concerns manufacturers Mercedes-Benz Group AG / Daimler Truck AG / smart Europe GmbH / Kia Europe GmbH and Volkswagen AG. In addition, if questions arise about specific repair execution, operational data from the vehicle that may be personally identifiable may be transferred to the manufacturer (technical hotline, vehicle diagnosis/remote diagnosis). Fault memory in the vehicle can be reset during repair and service work or at your request.

 

Cost Estimates / Cost Coverage by Manufacturer
If we prepare cost estimates for you, we collect the personal data necessary for this purpose (type of damage, vehicle concerned, where applicable insurance details and your contact information). If cost coverage by an insurer is desired, we forward this information to the insurer to examine coverage. In the event of a warranty/guarantee or goodwill request, the required personal data are forwarded to the manufacturer to examine reimbursement of costs.

III. Data processing for marketing purposes

My Kunzmann / Your Online Account
Via our online appointment scheduler you can book service appointments online and view your current and past appointments. For this purpose, we require various user and vehicle data from you. These data are stored and processed in our portal under appropriately high security standards, provided you agree to the privacy policy.

By consenting to the privacy policy, you agree to the transfer of your stored address and vehicle data to soft-nrg Development GmbH, the service provider for the online appointment scheduler. soft-nrg Development GmbH, Munich, will use the data solely to manage appointment scheduling. A linkage of the data with other dealerships using the same soft-nrg Development GmbH portal will only occur if you consent to this with the other dealership.

For marketing use of personal data
Regardless of any consent you may have given for processing your personal data for marketing purposes, we and our commissioned service providers (e.g. lettershops) process name and address for further customer retention and reactivation measures. This includes sending additional information about interesting products and services. In this way, we aim to draw customers’ and prospects’ attention to further attractive offers and achieve long-term customer loyalty. In addition, the dealership processes data arising from the business relationship for marketing analysis (marketing scoring/profiling and service optimisation), because we wish to present you only those products/services that we believe will interest you. This also includes data you provided in consultation about your product interests.

No data will be shared with third parties for marketing purposes unless you have given corresponding consent. Telephone number and email address will be used for marketing purposes – including sending information on interesting products and services and conducting satisfaction surveys. You may object to the marketing use of your email address at any time; you will be informed of this both when the data are collected and with every marketing communication.

Name, address and relevant personal data from the purchase of a vehicle or spare parts or the use of services will no longer be used for marketing purposes if you have not used any Kunzmann dealership services, purchased a vehicle/spare parts or ordered a vehicle from us for a period of 4 years.

Use of cookies?
Cookies are small pieces of information that the browser needs to identify you as a user during your online visit to the shop or websites, enabling you to shop and browse smoothly. For example, this controls the functionality of the “shopping cart” and its “save-for-later” feature. Cookies are stored on your hard drive by your browser only for the current session, require minimal storage space and do not affect your computer. Cookies do not contain personal information. Most cookies we use are deleted from your hard drive at the end of the browser session (so-called session cookies). Other cookies remain on your device and allow us to recognise your device on your next visit (so-called persistent cookies).

Most browsers accept cookies by default. In your browser software’s security settings you can permit or block session and stored cookies independently. If you disable cookies, certain features of our website may not be available and some pages may not display correctly. Of course, you can still view our online offering without enabling cookies, albeit with limited functionality. To disable cookies, please consult your browser software’s instructions.

Without your express consent, we will not link the data stored by the cookies used in our online shop with your personal data (see above). To use our shopping cart, session cookies must be enabled. If you wish to adjust your cookies, you can do so via “Adjust cookies” in the footer.

Subscription to an email newsletter
We will send you an email newsletter after your prior express consent or in the case of an existing business relationship from an online purchase, until you revoke it. We have commissioned SC-Networks GmbH to send the newsletter. This company compiles statistics for us on newsletter access. This provides the dealership with an overview of how often the newsletter was opened and how many subscribers viewed a product. These data are collected solely in statistical form and are anonymous.

Registration via website:
Our newsletter is only sent after completing the so-called double opt-in procedure. Users who choose to subscribe receive a confirmation email to prevent misuse through false email entries and to ensure that a simple, possibly accidental click does not trigger the newsletter dispatch. You can unsubscribe from our newsletter at any time. An unsubscribe link is included at the end of each newsletter.

We are also obliged to record proof that our subscribers genuinely wished to receive the newsletter. To this end, we store the date and time of subscription and unsubscription. Online shop: After receiving your objection, we will no longer use, process or transmit the affected data for any purposes other than processing your order and will cease sending you marketing materials. You have given the corresponding consent during the ordering process of our online shop or with this privacy consent declaration. Please note that you can revoke your consent at any time with effect for the future.

Cloudflare

We use services from Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA, and Cloudflare Germany GmbH, Rosental 7, 80331 München (“Cloudflare”). Cloudflare is employed to operate a content delivery network (CDN) and to secure our website against attacks and misuse (e.g. DDoS attacks, automated access). It also serves to improve the delivery speed and stability of our online offering.

 

In the course of use, IP addresses as well as connection and protocol data generated when accessing our website are processed. These data are processed for technical provision, security analysis, and error detection. Cloudflare may also use the IP address for geographical allocation to optimise delivery and presentation of our content.

 

The legal basis for processing is Art. 6 (1) f GDPR. Our legitimate interest lies in the secure, stable, and efficient provision and protection of our online offering.

Cloudflare processes data partly in the USA. For transfers to third countries, Cloudflare relies on the EU-US Data Privacy Framework and on standard contractual clauses under Art. 46 GDPR.

 

Cloudflare Turnstile

We use Cloudflare Turnstile to ensure the security of our online forms and to prevent automated entries (spam/bots). In particular, IP addresses and technical device and browser information are processed.

 

The processing is based on Art. 6 (1) f GDPR. Our legitimate interest lies in protecting our systems and online forms from misuse and ensuring the technical functionality of our online services.

Use of Facebook plugins

When you access a page of our website containing such a plugin, your browser establishes a direct connection to Facebook's servers. The content of the plugin is transmitted directly from Facebook to your browser and integrated into the page. Use of Facebook Custom Audience
Our website also uses third-party cookies, web beacons, or similar technologies from Facebook (Website Custom Audience) to collect or obtain information for providing measurements and displaying targeted advertising. Facebook Custom Audience generates a checksum from your usage data, which is transmitted to Facebook. These non-personal data are used for targeted marketing purposes. Chat Consultation with Userlike Software
This website uses Userlike, live chat software by Userlike UG (limited liability). Userlike uses “cookies”, text files stored on your computer that enable a conversation in the form of a real-time chat on the website. The data collected are not used to identify visitors personally and are not merged with personal data of a username holder. 

 

Weglot
Functions of the translation service Weglot are embedded on this website. The provider is Weglot SAS, 7 Cité Paradis, 75010 France. Weglot is loaded when the website is called, allowing you to change the language from German via the language icon in the header. Digital Voice Assistant “Lin”
We use an AI-powered digital voice assistant called “Lin” (the Voice Bot), an intelligent dialogue system capable of responding to natural language and interacting with you. The Voice Bot recognises your requests, understands context, and provides an efficient way to schedule appointments. Voice data are processed during this function solely to handle your requests and to improve our services.

Data we collect
When using the Voice Bot to schedule appointments, the following personal data are collected:
- Transcripts: texts generated from audio recordings of your spoken words.
- Additional data: information needed to arrange a workshop appointment, such as:
o Name,
o Contact details (e.g. phone number, email),
o Vehicle details (e.g. make, model, registration plate),
- Any other data you voluntarily provide.

Consent to Data Collection
Before transcribing your speech, your explicit consent is obtained. Your consent applies only to the current conversation and not to future contacts. This is done by a prior announcement that the Voice Bot will record your data. You may object to this recording at any time by hanging up or by saying “no” in advance. In the latter case, during business hours you will be directly connected to a human agent. Use of the Voice Bot is voluntary. You are free to contact us by other means without disadvantage.


Purpose of Data Collection
The collected data serve the following purposes:
- Scheduling workshop appointments
- Transcription to improve our service

Legal Basis
Processing your data is based on Art. 6 (1) a (consent), Art. 6 (1) b (contract performance), or Art. 6 (1) f (legitimate interest) of the GDPR. Your consent to transcription is required to use the Voice Bot. If you object, you will be connected to an agent without disadvantage.

Data Disclosure
We use a service provider to assist us in processing the data. We have concluded a data processing agreement with this provider to ensure your data are adequately protected. Data stored in connection with the Voice Bot are kept exclusively in the EU. No transfers to third countries occur.

Data Retention and Security
Data are deleted as soon as they are no longer required for the purpose for which they were collected, but no later than six weeks unless there are statutory retention obligations.

IV. Your rights as a data subject

Each data subject has the following rights:
- the right of access (Art. 15 GDPR)
- the right to rectification of inaccurate data (Art. 16 GDPR)
- the right to erasure or the right to be forgotten (Art. 17 GDPR)
- the right to restriction of processing of personal data (Art. 18 GDPR)
- the right to data portability (Art. 20 GDPR).

You may object to the processing of your personal data for advertising purposes – including profiling related to direct marketing – at any time without giving reasons.

Furthermore, you also have a general right to object (see Art. 21 (1) GDPR). In this case, the objection to data processing must be substantiated.

If the data processing is based on consent, you may withdraw this consent at any time with effect for the future.
